Abstract:
Governmental jurisprudence" has recently been a subject of special concern to scientific circles, especially in seminaries (hawaza Ilmiyah). On the other hand, "general policy" is a discipline which has a fairly distinct scientific literature. Although these two issues are discussed in two different contexts, we can have a clearer view of them when comparing them with one another. Using an analytical method, the present paper first analyzes these two concepts in terms of their own components, compares between them, and makes explicit the similarities and differences between them. The theoretical result of this comparison shows that these two concepts are similar in the outward and super structural aspect and different in principles. The practical application of this comparison is that only the structures and superstructures of the discipline of general policy can be used in developing the discipline of governmental jurisprudence. In doing so, we must consider their differences concerning the principles.

Abstract:
«فقه حکومتی» مقوله ای است که در چند سال اخیر، موضوع بحث محافل علمی، به ویژه در درون حوزهی علمیه قرار گرفته است. از سوی دیگر، «خط مشی عمومی» دانشی است دارای ادبیات علمی نسبتاً مشخص. این دو مقوله هرچند در دو فضای متفاوت علمی مطرح شده است، اما می توان با مقایسهی این دو مفهوم، دقت نظر بیشتری در هر دو مقوله پیدا کرد. در این تحقیق، با روش تحلیلی، ابتدا دو مفهوم به مؤلّفه های اصلی خود تحلیل شده و بر این اساس، میان این دو مقایسه صورت پذیرفته و شباهت ها و تفاوت های دو مفهوم بیان شده است. نتیجهی نظری این مقایسه آن است که دو مفهوم از لحاظ ظاهری و روبنایی با هم شباهت دارند، اما در مبانی مختلف هستند. از لحاظ کاربردی نیز نتیجهی این مقایسه آن است که در توسعهی دانش فقه حکومتی صرفاً می توان از ساختارها و روبنا های دانش خط مشی عمومی استفاده کرد، اما باید به تفاوت در مبانی به دقت توجه شود
